Welcome to CSM Performance (“we,” “us,” “our,” “CSM Performance”). These Terms & Conditions (“Terms”) govern your access to and use of www.csmperformance.com (the “Website”), and any orders placed through it. By accessing or using the Website, or placing an order, you agree to these Terms. If you do not agree, do not use the Website or place orders.
1. Definitions
· “Customer,” “you,” or “your” means any individual or entity accessing or using the Website or placing an order.
· “Products” means any automotive parts, performance parts, accessories or other physical goods offered for sale on the Website.
· “Order” means your request to purchase Products via the Website, subject to acceptance by us.
· “Service” means the Website and any associated order-processing, customer support, communications, or other services we provide in connection with sales.
2. Use of the Website & Eligibility
· You confirm you are at least 18 years old (or, if under 18, have parental/guardian consent) and legally able to enter into binding contracts.
· You agree not to use the Website for any unlawful or prohibited purpose. You will not upload, post, or transmit any content that is illegal, infringing, harmful, or otherwise objectionable.
· We reserve the right to refuse or terminate your access to the Website or cancel Orders at our discretion, including if you violate these Terms.
3. Orders, Payment & Pricing
· All Orders are subject to acceptance by us. We may refuse or cancel any Order for any reason (e.g., product unavailable, pricing error) even after you receive an Order confirmation.
· Prices displayed on the Website are in U.S. dollars (USD), unless otherwise specified. We reserve the right to modify prices at any time prior to Order acceptance.
· Payment must be made in full via the payment methods offered at checkout. You agree to pay all amounts due for your Orders, including applicable taxes, shipping charges, and any other fees.
4. Shipping, Delivery & Risk of Loss
· We will ship Products to the address you specify when you place your Order. Title and risk of loss pass to you when the carrier delivers the Products to the address you provided.
· You are responsible for ensuring the shipping address is complete and correct. We are not responsible for delays or non-delivery caused by incorrect information or carrier issues.
· If a Product is damaged in transit or lost during shipping, you must notify us within 15 days of delivery (or expected delivery), we will work with you and the carrier to file any claims.
5. Returns, Refunds & Cancellations
· Because we deal in automotive/performance parts, returns, exchanges, and refunds may be limited or restricted. Unless otherwise specified on the product page or at checkout, all sales are final.
· If you believe you have received a defective or incorrect item, you must contact us within 30 days of receipt. We will evaluate and, if appropriate, provide a return authorization, replacement, or refund, at our discretion.
· We reserve the right to refuse returns or refunds for any reason (e.g., improper use, installation damage, missing original packaging, or if return request is outside the allowed period).
6. Intellectual Property
· All content on the Website; including text, images, logos, designs, and graphics, are owned or licensed by CSM Performance and may be protected by copyright, trademark, and other intellectual property laws.
· You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from our content without our prior written consent.
· Product names, descriptions, and trademarks remain the property of their respective manufacturers; use of such trademarks is only to identify the Products offered.
CSM Performance (“we,” “our,” “us”) provides the following 12-Month Product Warranty for eligible products sold through www.csmperformance.com. This Limited Warranty applies only to physical products and covers defects in materials or manufacturing under normal intended use for a period of 12 months (365 days) from the date of purchase.
This warranty applies only to products sold directly by CSM Performance and does not cover installation or workmanship.
7. Warranty Coverage
This warranty covers manufacturer defects in materials or workmanship of the product itself.
Examples of covered defects include:
· Premature material failure
· Cracks or breakage due to poor manufacturing
· Defective hardware, seals, or components
· Product deformities not caused by misuse
· Improper machining, welding, or fabrication
· Internal component failure due to manufacturing error
If a defect is confirmed, CSM Performance will, at its discretion:
1. Repair the product, or
2. Replace the product with the same or equivalent item, or
3. Issue store credit equal to the product’s purchase price
All decisions are made at the sole discretion of CSM Performance.
8. What This Warranty Does NOT Cover
This warranty does not cover damage resulting from:
8.1 Installation-Related Issues
· Incorrect installation
· Improper torque, fitting, or adjustments
· Installation by unqualified individuals
· Damage due to missing or incompatible parts
8.2 Misuse, Abuse, or Neglect
Examples:
· Abuse, Excessive heat
· Chemical exposure, corrosion, or rust
· Modifications, cutting, welding, or altering the product
8.3 Normal Wear and Tear
8.4 External Factors
Not covered:
· Accidents, impacts, or collisions
· Foreign object damage
· Weather, salt, or environmental damage
8.5 Customer-Supplied or Used Products
This warranty does not apply to:
· Customer-supplied parts
· Used, refurbished, or open-box items
· Products purchased from unauthorized sellers
9. Warranty Claim Procedure
To start a claim, the customer must:
1. Contact us at info@csmperformance.com
2. Provide:
o Order number
o Product name
o Description of the defect
o Clear photos or videos
o Proof of purchase
3. Ship the defective product (if required) to:

Inspection must occur before approval.
Shipping Costs:
· If claim is approved, shipping will be covered
· If denied, customer may pay shipping to have the item returned
10. Warranty Evaluation and Outcome
After inspection, CSM Performance will determine whether:
· The issue is a legitimate manufacturing defect (covered), OR
· The issue is due to misuse, installation error, or external damage (not covered)
If covered:
· We repair, replace, or issue store credit
· Replacement may be new, refurbished, or an equivalent product
If NOT covered:
· The customer may request a paid repair (if applicable), or
· Have the item returned at their cost
11. Limitations of Liability
This warranty does not cover:
· Labor costs for removal or reinstallation
· Vehicle downtime, towing, rental cars, missed work
· Damage to surrounding vehicle components
· Loss of performance or fuel mileage
· Consequential or incidental damages
CSM Performance’s liability is limited strictly to the value of the product purchased.
12. Warranty Void Conditions
The warranty becomes void if:
· The product is modified, altered, or tampered with
· Serial numbers or labels are removed
· The product is installed incorrectly
· Damage occurs due to neglect or lack of maintenance
13. Transferability
This warranty applies only to the original purchaser and is non-transferable.
14. Governing Law
This warranty is governed by the laws of:
· Missouri and/or Illinois, depending on where the sale originated
15. Indemnification
You agree to defend, indemnify, and hold harmless CSM Performance, its officers, directors, employees, agents and affiliates, from and against any claims, damages, liabilities, losses, costs or expenses (including attorneys’ fees) arising out of or related to your use of the Website, violation of these Terms, or your breach of any representation, warranty or covenant herein.
16. Governing Law & Dispute Resolution
· These Terms and any dispute or claim arising out of or related to them, including non-contractual claims, shall be governed by and construed in accordance with the laws of the State of Missouri or Illinois, without regard to its conflict-of-laws principles.
17. Changes to Terms
We reserve the right to modify, change, or replace these Terms at any time. The revised version will be effective as of the “Last updated” date above. Your continued use of the Website or placing Orders after such changes constitutes your acceptance of the new Terms.
18. Severability
If any provision of these Terms is held to be invalid, illegal or unenforceable for any reason, that provision will be eliminated or limited to the minimum extent required so that the remaining provisions will continue in full force and effect.
